Terms of Registration at vipmobile.rs

The precondition for the use of additional services i.e. applications available via vipmobile.rs is Subscriber registration. During the registration process, the Subscriber will be identified via the Subscriber's phone number.

The Subscriber is obliged to provide Vip with true and complete information/data when such information/data are requested from the Subscriber for the purposes of use of applications or for the purposes of data updating. By pressing the 'I agree' button the Subscriber agrees with all the provisions of the Terms of Registration and fully accepts them.

When registering at vipmobile.rs the Subscriber chooses the user name and password. The user name must be unique within the system in order to be accepted for registration. It is recommended for the password to contain the combination of capital and small letters, numbers, and not to be shorter than 8 characters. Vip mobile reserves the right to change the parameters for formulation of password and user name.

The Subscriber agrees that Vip mobile may use and process the Subscriber's data required during the registration process for the purposes of provision of services selected by the Subscriber i.e. use of applications by the Subscriber. The Subscriber may withdraw such consent at all times. For provision of some services the Subscriber must previously conclude a separate Service Contract with Vip mobile. Vip mobile is entitled to additionally charge such services.

The Subscriber is obliged to take care of his/her user name and password initializing the access to applications. Vip mobile will not be liable in the event of third party's unauthorized use of the Subscriber's user name and password whereby access to applications has been initialized. If the Subscriber doubts in unauthorized use of the user name or password, the Subscriber will be liable for the use of his/her user name and password until he/she informs Vip mobile on the doubt in unauthorized use. The Subscriber is also liable for all the prohibited actions authorized and performed under his/her user name and password.

The following is recommended in order to reduce the possibility for misuse of the Subscriber's data:

- do not provide false data or information during the registration
- keep the identification data, user name and password confidential and do not enable unauthorized use or access to the third parties
- inform Vip mobile as soon as one doubts in unauthorized use or misuse of user name or password.

If the Subscriber does not comply with all the above stated instructions or other protective measures, Vip mobile will not be liable for the damages suffered by the Subscriber or for the third party claims towards the Subscriber, particularly the damages caused by improper use of the Subscriber's data by the Subscriber or third parties.

The Subscriber accepts that using the vipmobile.rs is at Subscriber's own risk and responsibility. Internet is an international computer network not directly controlled by Vip. Vip will not give any guarantees and will not accept any liability whatsoever for the damages suffered by the Subscriber when using the services or applications and will not be liable for any third party claims.

The Subscriber is obliged to use the vipmobile.rs site in accordance with all the effective legal regulations. The Subscriber must not use vipmobile.rs in a way that will in any way cause damages or jeopardize the interests or security of Vip or third parties. Services available via vipmobile.rs site are for private and non-commercial purposes only and may not be misused by the Subscriber. Documents, data and information published on vipmobile.rs must not be copied, distributed or in any other way used for commercial purposes without Vip mobile's explicit approval. Documents, data and information published on vipmobile.rs may be used for Subscriber's individual purposes only and in compliance with all the copyrights and ownership rights, and third party rights. If the Subscriber acts contrary to these provisions, Vip reserves the right to cancel the service availability to the Subscriber. The Subscriber agrees and guarantees that the materials he/she transmits via vipmobile.rs do not violate the relevant legal regulations, in particular the regulations in relation to intellectual property, third party privacy, criminal law, law on telecommunications, law on protection of personal information and any other relevant legal regulations of the Republic of Serbia and that they do not contain any pornography or other content that may be deemed offensive, obscene or inappropriate by third parties. In the event that the Subscriber acts contrary to this provision or in any way contrary to the effective legal regulations, Vip will not be held liable, the liability will be solely the Subscriber's and Vip will be entitled to be indemnified by the Subscriber in the amount requested by Vip, with the Subscriber having no right to submit a complaint.

The services available via vipmobile.rs site must not be used:

- to collect e-mail addresses or other contact information or for other prohibited purposes
- to send messages
- to disturb the web site operation
- to use automated scripts to gather web site information
- to provide false or inaccurate information and identification data
- for obscene or offensive content, to offend third parties or in a way that would in any way cause damages to Vip mobile or third parties or in any way jeopardize Vip mobile or third parties
- to misuse systems, data, services of Vip mobile or third parties
- to create content that is not in accordance with legal and other regulations or harmful content

Vip is authorized to remove or disable further distribution or accessibility of the content, as defined above, which misuses the Subscriber's rights or violates or jeopardizes the rights of Vip mobile or third parties, without submitting a prior notice to the Subscriber and without the Subscriber's consent.

Availability of certain services via vipmobile.rs may be provided by third party service providers. The Subscriber may use these services only if he/she pays a fee for using the services to such third parties. In such a case Vip mobile is not liable for the content and appearance of applications and for the availability or quality of services provided to the Subscriber by the third party service providers.

The Subscriber accepts that the services at vipmobile.rs site may not be available at all times due to the maintenance of the system or other traffic conditions. Vip mobile is entitled to perform occasional system maintenance during which the services may be unavailable. Vip mobile will not be liable for the temporary unavailability of the service or for the loss of the data stored due to the maintenance works or sudden and unforeseen technical failures or other technical problems and for the service interruptions due to the reasons beyond Vip mobile's control.

Vip mobile is not liable for the Subscriber's content. Vip mobile is not obliged to indefinitely preserve or store the Subscriber's data. In the event of the Subscriber's inactivity (not using the service i.e. applications) exceeding 6 months, Vip will be entitled to delete the Subscriber's identification data.

Vip mobile will not be liable for the lost profit, lost data, indirect or consequential damages or damages arising from the Subscriber's or third party claims.

The Subscriber will not hold Vip mobile liable for any errors in the application operation, deleting of data, defects in service providing or delay in data transfer. The Subscriber will not hold Vip mobile liable for the completeness, accuracy or updatedness of data the Subscriber is able to access via vipmobile.rs.

Vip mobile fully waives any liability (i) that may in any way arise from or that is in any way connected to the use of vipmobile.rs (ii) for any actions of the Subscriber by using or misusing the content of vipmobile.rs and for (iii) any damages that may be suffered by the Subscriber or any third party in relation to the use or misuse of vipmobile.rs content.

Vip reserves the right to change the rates for the use of services at vipmobile.rs in accordance with its business policy, however it is obliged to inform the Subscriber on the amended terms of use for the given services by posting the respective information on the web pages.

Vip mobile is entitled to cancel the service availability i.e. access to applications at all times, in case of which all the Subscriber's data will be deleted. The Subscriber agrees that Vip mobile is not liable for any damages caused by restricted or cancelled use of services i.e. applications due to any reason.

Vip reserves the right to amend these Terms of Registration or content available at vipmobile.rs without providing a special notice to the Subscriber. The new Terms of Registration will become binding upon the Subscriber by thereof publishing. Further use of the service i.e. application available via vipmobile.rs will be deemed as Subscriber's agreement with the new Terms of Registration or other amendments. If the Subscriber does not agree with the amendments that were made or does not wish to use the applications available via vipmobile.rs any more he/she should inform Vip thereon.

The present Terms of Use as well as all other relations arising therefrom fall under the jurisdiction of the Republic of Serbia.
